I think it's if you canceled your service before your contract was up and they charged you a fee for doing it.

yo booboo u gotta study up on your facts...its not illegal if they charge u if u cancel your service before ur contract is up... in-fact its actually in their contract that u signed that u wil be charged like $200 if u do it so just throwin that out there and prolly the only reason u could do the lawsuit is if they charged u for something like they charge u for say a phone that u never even bought from them and they charge u for it that type of thing

The facts are:  It clearly states "Early Termination Fee."  It says nothing about purchases of phones etc.  At least not in the link provided.

    *  A proposed Settlement is pending in a class action entitled Milliron v. T-Mobile USA, Inc., No. 08-04149(JLL) (ES) in the U.S. District Court for the District of New Jersey. The lawsuit alleges that T-Mobile violated state and federal laws by charging customers a flat-rate early termination fee (“ETF”) in its wireless telephone service contracts.


    * You are part of the lawsuit if you are a current or former T-Mobile wireless subscriber who paid or were charged a flat-rate ETF from July 23, 1999 to February 19, 2009, or if your contract for service included a flat-rate ETF from July 23, 1999 to February 19, 2009.

well i know that in the contract that u sign with t-mob that it says no early termination so that lawsuit is going to crash and burn in itself... or it is a false lawsuit

Yeah, it probably won't amount to anything.  I'm not sure how they can sue when a contract is signed agreeing to early termination fees, but then again, people sue for crazy stuff all the time and win so who knows.

Weird I never thought flat rate early termination fees were illegal. I actually just paid one last year for someone who had their sidekick LX stolen that I had on my account.

are you people dumb?Huh They are illegal in some states.... and contracts don't mean anything.

If I were to lets say go sky diving and I sign a waiver saying I agree not to sue if anything happens and I get hurt I can still sue.. look into it happens all the time.

just because you sign something  saying that you agree to it doesn't make it law. if that was the case I could sell drugs cause my "dealer" made a "contract"
